and is the top or bottom wing stay for the drivers side

to put a limit on the amount of lock, carefully remove the gaters on the steering rack and fit large jublie clips around the steering rack arns 1 on each side, these will act as stops.
refit gators pain in the rear to get the gators back on.

do not know about question 2 .

Think bottom one is for the drivers side as the flat the attaches to the wing should be nearer vertical than the flat that attaches to the back of the cycle wing.

Yep, the bottom one is the off-side wing stay. The leading edge, like Pat says, should be near vertical when in position.

Personally, I would not use jubilee clips as stops for steering lock. Can you not get access to a lathe or get someone to machine a couple of spacers for you with the correct diameters and length? These can then be simply placed on the rack by unbolting the steering control arms and sliding them on.

To prevent the brake flexi's from catching, it is possible to turn the fitting where it exits the side panel and introduce a slight twist in the flexi which prevents it from touching anything when the steering wheel is turned.

Only problem there, is that its a Sierra rack the stops are for. Don't know how the diameter of the rack compares on the Escort.
