Yes it will fail. They checked mine at SVA.
And it was one of the things that the black indy at the newark show had failed on.

They were saying on the MK stand at Newark that alot of people do fail because of no restrictor, mainly because its something that get forgotten
about.

Is one only needed if you have a CAT?

SVA Manual says;
"On vehicles that require a "Catalyst Test" (see Section 18, page 1 I, check that the fuel tank cannot be Filled directly from a
petrol pump nozzle having an external diameter of 23.6mm or more."
Therefore, if your car won't be having a "Catalyst Test" you don't need the filler neck restriction

That's good news because my car doesn't have a cat so no need for a restrictor, and I was going to fit one.
Why does a car fitted with a cat need a restrictor any way? what does it do?
7 out of 10 people suffer with hemorrhoids. Does that mean the other 3 enjoy them?

Stops you putting the wrong fuel in which could destroy the cat.
Bloody stupid if you ask me!

We fitted one on ours for SVA but didn't realise it wasn't needed
Still, it fits snug around the unleaded nozzle and avoids overspill........ and we can't be arsed to remove it
