Insurance advice?

After a bit of advice...

Earlier today decided to take the old dear out shopping, So got in the car (Which is brand new well two weeks old!)

I live on a Thin Rural lane which is a hill and has limited number of passing places. So i'm coming down the hill see the other car she sees me but I have no where to pull in to. but she could stop at where the road splits in two normal procedure!

As I get down she carries on coming I pull over as far as I can and stop. She didn't give me a chance to reverse too the nearest passing place 100 ft back up the hill! She carried on coming and hits the rear bumper and quarter of my car! If she stopped like other people 10 ft down the road to let me by it would of been ok.

Ok so me being a little annoyed by this point got out the car for her to say why are you angry and say well its obviously your fault I was coming up the hill ( which I know is the rule of the road but still it wasn't eligible)

So who's in the wrong Me or her? Cant talk to insurance till tomorrow as they are not open

if you were not moving it must be her fault

I feel your pain.

We have lots of lanes like that around here - a lot of people have no idea how to react - I'm sure some of them shut their eyes and hope for the best.

Claim wise - my guess would be they'd go 50 - 50 on it.
I hope you've got NCB protection - not that it will stop your premium going up next year.

Hope I'm wrong.

Not what I want to hear. Nope no no claims protection, I got free insurance for a year with purchase of the car! Most of all 'im worried about insurance for the R1 Indy as i'm 20 now it will be built when I'm 21 and I have clean license and 3 years no claims. Can't believe it wasn't even moving and she lives around the block she should know how the lane works of all people i want to go an knock on her door and shout but i wont!

Unfortunately if there are no lane markings in the road then the insurance company will go 50/50.

I got hit a few years ago in a country lane and same as you was stationary but the claim still went 50/50 despite my protests.

The only saving grace was it was a company car/insurance, however it did affect my own insurance premium on renewal.

thats the important bit you were stationary make a fuss about it.

devon and cornwall lanes are full of people that can't think in advance or reverse.

You were stopped, she drove into you - blatantly her fault.

If you dont have legal protection through your policy, i'd seriously consider getting a reputable legal specialist to pursue the claim against her. As said, insurance companies are all too keen to split 50:50 which will cost you your excess.

I personally would get a legal specialist to help and put in a claim for compensation against her as even if it comes out in your favor there maybe a mark on your cars record of a repair which would reduce its value.
I would probably do this even with legal assistants as I have known people who have been hit but insurance gone 50/50.
The no win no fee types will be willing to fight the most.

Thanks for the Advice guys. will talk to the insurance company 1st thing and hope they are ok to deal with! If I have to take it further with legal assistance I will as its just not fair that someone hit me and i'm going to suffer the consequences!

Just asked the missus who is sat next to me, she worked in disputed liability motor claims for a major UK insurer for about 8 years until recently.

Her opinion is that if the woman admits exactly the circumstances that happened you should be ok, however, if she says you were both moving and you have no independant witnesses then I'm afraid you're looking at a 50/50.

the bad news is, she will almost certainly lie when she speaks to friends and family and realises she might get fingered (so to speak).

I would attempt to get a clandestine recording of her admitting guilt, even if it wouldnt be admissible!

got a feeling this one will go 50:50. I know its not what you want to hear, even if you purue it through a specialist her insurance company will ask for proof that she caused all of the damage ( cctv) that you won't have.

the highway code states that the preson coming down hill should reverse back up the hill.

dunno why she did this, totally stupid behaviour - now has caused trouble for both parties - it would have taken 10 seconds to back up but instead you both losts minutes discussing and swapping details for what benefit?

some people deserved to be punched hard in the head. really.

I totally agree well spoke to her insurance company today and it seems she hasn't contacted them so she will be contacted I just hope she tells the truth! I also spoke to a ex traffic cop who seems to think I would of been committing an offence to reverse that far up a hill on a country lane.

She admitted liability will all go through her insurance So i wont loose my no claims and am happy. But still not happy that my new car was hit but there is some dim wits behind the wheels of cars!
