Bought 3 items 1 month ago from the same seller. Same item but 3 in quantity.

He then emails me to ring him. He told me that the item was out of stock so i didn't pay him as he promised to find some and send them over and i would pay him then.

I just texted him again and he still hasn't got them.

Can i notify ebay and leave a negative feedback without him leaving feedback as i haven't payed him?

As you have waivered from ebay rules, cancel the orders and go elsewhere. No need to leave negative feedback is there?

Agree with Steve, you've not lost any money and he did tell you he'd run out. Cancel and move on.

What is there to learn though? There's no way to tell beforehand if the seller is advertising goods they dont have in stock.
I agree with your first comment though, cancel & go elsewhere.

Yes but, I wanted the item so i can take it with me in Greece in order to sort my car during half term.
There is no way i can find one now and be delivered to me by friday without spending a fortune.

How did i waivered through ebay rules?

Yes, and there aren't any on ebay at the moment.

So I have to go to the main stealers.

I had something similar - seller advertising some gloves i wanted. As soon as i bought he told me he had none in stock but he could try to source. I really wanted them so i said "yes, please source". After two weeks he said he couldn't source and gave me my money back.

Why advertise if you don't have it?

If you didn't pay him you didn't buy them. If you had paid him and not received them you could report him as a non performing seller. You failed to seal the deal so you have no comeback.

loads of ebayers are just getting items drop shipped from their surplyers so if the surplyer is out of stock then there is nothing he can do, we do it at work for instance a sat nav in halfords is £200 we buy at £120 and the trade dealer just sends the item straight to you simples

Ebay have told me it's against their TOS to advertise something they don't have, the only exception (annoyingly) is concert tickets

I've had that happen to me too, sellers shouldn't say they have it in stock if they are relying on someone else to deliver it. I've nothing against people drop-shipping as long as they don't claim they've got plenty in stock when they haven't as they are basically lying.
