Bought a trailer from an auction 3 weeks back, plod came and took it away tonight, its stolen, there happy I'm not the thief, receipt , lot number etc, will be on phone too auction 1st thing in morning, where do I stand financially ?

The plod told me about a 14K evo he had too take away last week, the guy had a bank loan on it too.................

Can I claim off the seller ? I know the auction house only act as his agent ?

I would have thought the auction house had a legal resposibility to warrant anything it auctions as being "clean"?

Hopefully you should be able to claim a refund from them.

You payed a buyers premium so you should be covered.

As said, the buyer's premium you pay is supposed to cover you against this sort of thing.

I used to buy quite a few things at an auction in Telford befor ebay finished it off.

There was always an indemnity charge on lots above £20 to cover against the item being stolen and it was compulsory to pay it. So you should get all your money back.

Also the auction house will have the details of who entered the lot so it may well be worth getting the Police to make enquiries.

Eventually the trail will lead to the thief or someone that can be done for receiving ie no receipts etc.

If you bought stolen goods from an auction house, are they guilty of handling stolen goods?

About twenty years ago, my brother in law had a concrete breaker stolen off of his JCB. All correct procedures were followed and because the thieves didn't take the controls for it the importer was informed . A few months later the importer contacted my brother in law saying they had someone in to buy the controls . Having taken the guys details the police were informed . It turned out that because he had brought it in good faith from an auction (in Telford funnily enough) he was entitled to keep it . As the buyer was a dealer in plant equipment my brother in laws insurance co brought it from him and returned it to my brother in law. Might pay to take proper legal advice on it?

CAB (citizens advice bueru) offer free legal advice. The drawback is that some CAB offices are better than others when it comes to actually being helpful. My local one is shockingly useless however others are very good. It might be worth checking out your local office to see which braket they fall into.

Its actually looking good, seems the auction house are gonna cough, it seemed too spare them on a little when I asked if they minded if i jumped in during an auction and explained too all the public etc that if they buy from here and its stolen your on your own......

too be fair plod have been good too, very human and understanding, they have the name address of the guy that put it in for sale and whilst they cant or wont tell all it seems he is having trouble proving it was his too sell.

Out of interest, how did plod come to know 'your' trailer was stolen in the first place?

2 reasons, main one been it was for sale on ebay, 2nd one we live on a very busy road feeding a very busy junction on the M1 and it was up for sale roadside.
The rightful owners spotted it on ebay.
