Tin top Insurance questions
Sorry for the long introduction but I need to set the scene a bit!!!
In march last year someone reversed into the wife's car (An Omega) (smashing the grill and bumper and pushing the fans back into the radiator.
at the time he told her it was her fault as she should have seen his reversing lights :-0 and wouldnt give her any details apart from writing down a
registration number on a busniess card which was different to the one on his car (He'd used black tape to change two numbers to spell his name)
He got shirty when she called me to the scene and the long and short of it was he drove off. Anyways we spent months chasing via the insurance,
who'd tracked him down via the central database) and you guessed it he says she hit him. and now wants her to go to court, she's terrified
cos he's not a nice bloke.
Three questions really
1, There was no damage to his car (S Class Merc) and he claimed he had it fixed (which he cant produce a bill for) so do you think that's worth
anything. (I guess an S class is much stronger than a Vauxhall so maybe physics dont apply!)
2, Could I get some kind of expert to give an opinion on damage (Seem's extreme but I dont want to give in)
3, Has anyone ever been to one of these things and how bad are they, she's scared to death...
A bit of a rant but but I've alway's towed the line and played fair and this guy's got right in there under my skin, as it seems
everything suits the dishonest one..

if first he said she should have seen his reversing lights but then said she hit him he's already changed his story so thats one thing
you've got on him.
if he drove off then he's left the scene of a accident.
if you can prove he inentionally gave false details then again you've got him.
you say your wife is scared to death of going to court but thats exactly what he wants to happen so she'll back down.
be strong and don't let him bully you down
built a car, built a home, had a family. lost the family, lost the home, still got the car.

Take the F***er to court. At th e end of the day though it could end up knock for knock   . At thr time you should have prolly got
the cops invoved re the tape on the number plate and failure to give proper details. Also if the details are wrong and he left the scene of an
accident etc.
I'd get proper legal advice from your solicitor first. If all else fails have you got his address etc . The rest you make up yourself. Just
remember revenge is a dish served best with no witnesses.

If you do have to go to court, which is unlikely because the insurers will almost certainly go knock for knock, Which is unfair I know,Make sure you
have witneses with you in case he tries to intimidate you, they would hang him for that. He is probably a known ar**hole anyway.
Blag it out and you should at least get something, It took me two years to get compensation from a idiot who knocked me off my Motorbike, He
appologised at the scene and then went to ground and denied everything,Stick with it.

As she is chasing it through her insurers
has her policy got free legal assistance or if a member of AA or RAC they can help.
My word of advice contact the police go after him cos a bully always runs away like a coward when a bigger stick appears
He has broken at least three traffic laws

the police unfortunately will probably not be interested. It happened to me once, they said that once you left the scene it was a civil matter. I
would've argued harder if i had been older at the time, as the twat had no insurance.
Good luck anyway.
Against you, there is the lack of any witnesses. In your favour, is that he never swapped details and has no bill or repairs, hence nothing to claim.
Id not give up myself anyway.

Exactly the same thing happened to the missus....
Car hit her, (Izuzu tropper), scrapped osf wing & door. The driver got angry and drove off. Contacted police, 'anyone hurt' answer
'no' then its a civil matter. Tried to take it further to no avail. Insurance got involved, they sent assesors around to the other drivers
house, left due to threatening behaviour ! Then the bast*@@ds filed a claim against us for an accident on the previous day claimed we had rear ended
them and caused £1000 worth of damage.... Hard to hit a car with the drivers door !
Anyway after 1 year the insurance refunded our excess, missus so un-nerved with it all sold the car due to memories and purchased something else.
Insurance went up by £400 p.a (new car is the same insuarnce group) as we had claimed, police still not interested.as I tried to report the other
party for no insurance, but only insurance companies can do this apparantly.... all in all a very bad experience, Personally I would not bother to
persue as its not worth the distress..

Spoke to the Insurers today and they say they will persue it as he is now not making any claim for damage. we have a letter from him to his insurance
company where he said he had a repair quote. which he does not. Im hoping that will be the barrel we have him over.

Insurance companies don't appear to work for the person who pays them, that is what is seams anyway, I also had a claim against another driver,
who cut me up without looking and took out my n/s front wing, bumper and wheel, he drove off at high speed and denied it ever happened, I had no
witnesses so It's my fault !! go figure ?? not to sure why we pay for legal aid either, they only persue if the other party admits it, so why do
we need the cover ????????????
