ot car insurance seems strange
Hi
Following on from a non fault accident last week, seems the insurance company have had an engineer from the other insurance company look over the car
and decided its a total loss. Question is, when I got home from work today there was a card through our door from the other party's insurance
asking me to call. So I did, he wanted our side of the story as his insured driver had failed to give an account of what happened. He then gave me an
offer for the car which was the usual too low then he offered 2 lots of compensation for injury to my wife and 9 month old son. Is it usual for the
other insurance company to offer this or are they trying to stop me from taking it through our legal team via my insurance company??

Odd indeed. I wouldnt be suprised if they are trying to limit their risk by making an early offer and hoping you bit. I would suggest getting
independant advice regarding any personal injury claim. They probably want to avoid you speaking to a claims specialist who will milk the situation to
the max - ie physio visits etc.
However, you will know how much you want back overall, so i suppose if they have exceeded this figure, why not go for it?

I just had a similar experience, and recieved a no quible settlement from the other drivers insurance co.The offer was subject to my relinquishing any
right to claim for personal injury.As I had not been injured , it seemed fair to me.There seems to be a trend for Insurance companies to settle
without going through the legal process.A note of caution---- Make sure that you or your family didnt suffer any trauma that might surface at a later
stage. If this is the case then, I would settle, provided you are happy with the overall settlement sum

As a general rule they're not trying to stiff you into accepting a lower settlement, it's more so they can avoid legal costs.
If your claim is say £1500 then you solicitors costs will be around the same so a total of about £3k. So it makes sense for them to offer you say
£1500-2000 saving them a grand.

As said already, they will try to handle your claim to avoid extortionate legal and accident management costs. In theory this should not mean you will
get a low offer. I would try to haggle with them on the grounds that other companies will probs get 2x or 3x what you will get on top of your
settlement. Dealing direct will save them loads so you should try countering their offer by adding at least 50%. If they dont play ball just say you
are going to appoint an accident management company to act on your behalf.
I used Accident exchange last year. Did a fantastic job, however their (and their solicitors) charge were far far higher than wha i recieved.

Tell them to get stuffed, you tell them what you want or you go through your insurance and the courts. My son lost around £8k 12 years ago and has
been in pain on and off since. Don't fall into the same trap we did.

I have not accepted anything yet. I already have my insurance legal team looking into it.
They offered me £2500 for the car. Book price £3100
£1200 for my wife's injury &
£400 for my 9 month son's
I am going to speak with him again on Friday apparently
P.S 1 hr to go.....

I was in a similar situation 2 years ago and took them 9 months to sort out.
Yours might be quicker, as the other insurance company has already tried to compensate you for it.

STOP!
DO NOT ACCPET ANYTHING
SPEAK TO YOUR INSURANCE AND ADVISE THEM THE OTHER PARTY IS TRYING TO COMMUNICATE WITH YOU DIRECTLY AND ARE TRYING TO GET YOU TO ACCEPT LOW PAYOUT.
IF YOU HAVE PUT THIS IN THE HANDS OF INSURANCE LET THE TWO COMPANIES SORT IT OUT.
Could be beacuse there driver was "drunk" or something and his INSURANCE are trying to protect him in some form. strange but I WOULD SEEK
LEAGAL ADVICE before doing or accpeting anything. Possible even 3rd PARTY Leagal advice.

i have not accepted anything, in fact spoke to my solicitor this morning and they said they had sent me a letter advising me of the under hand tactics
of this company and to not talk to them. So if he calls back I will simply refer him to my solicitor and get them to fight it out.

This is why Solicitors are Millionaires , and Insurance costs are so high.It seems that creating a confrontational situation is the order of the
day.What has happened to common sense???.If you are happy with the offer--- why make these greedy people any richer??

If he hasn't given his insurance company a statement why are they doing anything? No-one volunteers to hand out money!
