Company car insurance advice

This is a bit long winded but I'll try to keep it short.

I was being overtaken on the A12 when the car that was overtaking me veered into the side of my company car and ended up scraping and denting the car all down the drivers side.
When we pulled over I asked him WTF he was doing and he told me he had fallen asleep for a few seconds. I called the police but they as usual were not interested and wouldn't come out.

The other driver is now saying I hit him and of course I am saying he hit me and my company are settling for a 50/50 claim as it is more cost effective for the company as if they loose it will cost more. It is clear from the damage on my car and the other driver's that he had to have hit me to cause the damage to both cars.

As they are settling for a 50/50 claim I now have this on my driving record and have to declare this on my insurance so it will hit me twice. Once for my kit car and the second for my own private car.

Is there anything I can do?

Company car. Do you really have to declare it to your insurance? I used to drice wagons and they're always hitting things but no one declared it there plus I may have pranged a few landies in the RAF but I never declared them.

I declared an accident in a works van and was told it would not affect my personal insurance as I had not claimed from them.

I dont know how people can look in the mirror telling a bare faced lie like that. Ive had it myself though where a guy rammed me on a roundabout and later said id pulled out into him - clear from the damage that we were parallel, not at right angles, but no way i could really prove it. Had to settle 50/50 and declare it in future...

be careful - whilst you won't get your no claims affected as it wasn't your vehicle, you will find your insurance goes up.

Simple test - do an online quote for Mr Smith at your neighbours house. Once you've got a price 'remember' about your accident, add it to the quote and see what happens. Then add another ....... even if hte first doesn't increase it, if you're unlucky and have a second see what happens.
