Went past a policeman today with a radar gun (in North Yorks)
Was in a 40mph limit zone and am unsure if I was over the limit or not. How much over do you have to be before you a given a penalty?
Also how long before the ticket would come through?

Was it a camera van or just a policeman with handheld?

Dont they usually stop you if heldhand?

same thing happened to me in last year....week later ticket came through post 43mph in a 40 zone, ended up doing speed awareness course to avoid points

It was a policeman with a handheld. He was stood outside the police car and there was about 5 policemen stood around.

You should be safe. Hand hel guns (radar or laser) give a live read and dont record any details, so the officers need to stop and issue you with a ticket (fixed penalty notice)
Mobile cameras (usually built in to a car/van due to the size of the equipment) are live cameras and record the speed and numberplate, which goes back to a office to be processed and FPNs issued. (within 14 days)

Handheld they should pull you over, normally at the scene.

Either way, they have 14 days to POST the ticket and you can be 1mph over the limit to be done theoretically.

The 10% "rule" + a little bit is complete bollocks.

Thought you could go 10% over the limit before you get done.

5 Policemen stood around???
In that case, you'll be ok - you should be allowed (5+1) x speedlimit = 240 miles per hour.

6 of them? - sounds a bit fishy to me - maybe a training and/or trialing new equipment session?

How about just keeping the speed under 40mph?

That avoids any anxious moments and saves you a bit cash....

I got given a picture of the car when I got caught, complete with the registration, time, date and speed. Couldn't argue there.

I think the 10% thing is so there's no doubt on either side. If they try to ticket you for doing 31 then you could always say "no I was doing bob on 30" and claim your speedo isn't 100% accurate (what's the reading difference between having 8mm and 1.6mm tread on your tyres?)

10% + 2 is ACPO guidelines. If you get done for 1mph over then you could take it to court and easily get it thrown out on a technicality (opperating tolerances etc).

If cameras were set to anything closer than they are (ususally 10%+2) the police/camera units would be overun!

i once saw one and broke hard as i approached, the speedo still read 10mph over as i passed the van, but the ticket (assumedly read further down the road when i was going a touch faster) only said something like 46 - ie, you speedo will usually read a lot higher than you really are doing.

Ive started doing +10% though speed cameras and havent had a ticket yet.

according to my sat nav my speedo reads 3mph faster than what i am actually doing so it could be either that is correct. at the end of the day everyone speeds, getting caught is just bad luck. sorry if anyone disagrees with me but thats the way it is. personally i like driving fast when i can as im sure everyone on this site does, but i am also a big boy and will hold my hands up and take the punishment when i get caught.

i got tugged by a police skoda in the seven going like a hooligan through an empty tunnel, he commented that if i hadn't of stopped he was ready to call for high speed backup as he couldn't keep up. i manned up admitted that i was in the wrong and apologized ready to receive my fpn, instead i got a good telling off and sent on my way with my tail between my legs. he said if i hadn't of owned up to being in the wrong then i would have been getting a fpn, so it goes to show trying to worm your way out of it wont help.
