Bad Day Follow up follow up

Further to my post about crashing my MK Indy.
The bastards have made it a category B and want to crush it.
I have pleading my case on the phone and the best I have managed is to buy back the car but ,I have to surrender the V5,Mot and let them have the Chassis to crush later.
Gutted
means building into another chassis and going through the IVA.

What! In the pic in your archive the car doesn't look to bad. Certainly fixable! Unless there is hidden damage?

The Chassis is badly ripped up around the front suspension mounts and the back R/H wheel points out at 45 degs.
The rear suspension is OK its the chassis thats given.
The Gaps around the engine are all wrong as well. The Chassis is U/S and thats all he looked at.
If I want to re-Chassis it I have to re-register
God knows I have been pleading on the phone.
The Insurance people agents Innovation group have been really good and are fighting my case but the Assessor wont change his mind

You shouldn't need another SVA/IVA if you get a replacement chassis from MK and put the old bits on it. On this site it says:

"Vehicles that have been rebuilt using a mix of new or used parts

In order to retain the original registration mark:

* cars and car-derived vans must use:

The original unmodified chassis or unaltered bodyshell (i.e. body and chassis as one unit - monocoque); or a new chassis or monocoque bodyshell of the same specification as the original supported by evidence from the dealer or manufacturer (e.g. receipt).

And two other major components from the original vehicle - ie suspension (front & back); steering assembly; axles (both); transmission or engine.

If a second-hand chassis or monocoque bodyshell is used a car must pass an Individual Vehicle Approval (IVA) and light goods vans must have a enhanced single vehicle approval (ESVA) or single vehicle approval (SVA) test after which a "Q" prefix registration number will be allocated."

Since you would be using a new chassis of the same type and (presumably) the original engine, etc. you should be able to MOT it (+ maybe VIN check?) and put it back on the road with the original reg. Don't know if it is different if it was originally a Q plater though

Sorry to hear about your problems.

I'd be getting the car back to yours. Then I'd be getting an independant claims guy in on your side.

Hope you get it sorted.

Can I ask who you are insured with, so I can avoid them??

Mike

The Insurers are called KGM the brokers were M R Bloor.
To be fair tp KGM have been ok,
I bent the car on the 5th and got a cheque today.
the problem lies with the Independent assessor calling it a B instead of a C.

The only way out I can see is this - send the insurers the cheque back , and tell them to cancel the claim - if you are not claiming , they cant write it off , surely ?
Then find another chassis or repair yours at your leisure - probably work out cheaper (unless you have a very good agreed value ?) , and you get to keep your car without all the hassle of building a new one and paying out for IVA .
Thats what I would do - but then , I would do just about anything to avoid making a claim

Presumably if you were so inclined you could get your own indepedent assesment which could say it's a C and go back to the insurers and argue the to$$. I'd certainly do that rather than put a whole new car through IVA.

All depends on whether they decide it "can / should be repaired". Pretty damn subjective in my book!!!

Don't bank the cheque, I'm sure I have read possibly on the newsgroups where a similar situation arose that once you bank the cheque you have deemed to have agreed with their decision.

If so , it's about 2 miles from me.........
